Understanding EPFO
What Is EPFO
The Employees’ Provident Fund Organisation (EPFO) is a government organisation that works under the Ministry of Labour and Employment, Government of India. It helps employees save money for their future and provides financial support through provident fund, pension and insurance benefits.
EPFO manages three main schemes: the Employees’ Provident Fund (EPF), the Employees’ Pension Scheme (EPS) and the Employees’ Deposit Linked Insurance (EDLI) Scheme. Under the EPF scheme, the employee and employer contribute towards the provident fund as per the applicable rules. The money saved in the PF account earns interest at the rate declared by the government, helping employees build savings over time.
One important thing employees should know is that PF money is not only meant for retirement. During employment, an employee can apply for a PF advance for certain needs, such as medical treatment, house purchase or other permitted purposes, subject to the applicable rules. After leaving a job, an employee can also apply for PF withdrawal or transfer the PF balance to a new employer, depending on their situation and eligibility.
EPFO also provides pension benefits to eligible members under the pension scheme. The EDLI scheme offers insurance benefits to eligible nominees or family members if a covered employee dies while in service.
For employers, following PF rules is an important part of employee compliance. This includes maintaining correct employee details, depositing PF contributions on time and completing monthly filings. Proper PF compliance helps employers meet their legal responsibilities and helps employees maintain their PF records and access eligible benefits when needed.

Who Must Register ?
Any Establishment crossing the threshold limit of 20 or more employees must mandatorily register EPF registration under EPFO CoSS 2020. And once covered, an establishment remains permanently cover under EPF even if the employee count later drops below 20.
What will be the contribution rate ?
Under the EPF scheme, both employer and employee generally contribute 12% each. The employee’s full share goes to EPF, while the employer’s share is divided between EPF (3.67%) and EPS (8.33%). EDLI and administrative charges are paid separately.
Voluntary Registration
company has fewer than 20 employees, PF registration is not mandatory but you can still choose to register voluntarily. This is called Voluntary Coverage under PF. Once you register voluntarily, all the same PF rules apply company just like they do for companies with 20 or more employees
PF Registration Depends On The Type Of Establishment
It’s important to choose the correct EPF registration route and the route you take depends entirely on the type of establishment you run — and getting this right from day one saves you a lot of unnecessary trouble later.
MCA Portal
(During Company Incorporation)
Private Limited, Public Limited & One Person Company(OPC).
Here is something most new business owners miss — if you are incorporating a Private Limited Company, Public Limited Company, or One Person Company (OPC), your PF registration does not happen separately. It happens automatically through the MCA Portal as part of the company incorporation process itself.
This rule has been in place since 08 October 2020. From that date, all newly incorporated companies of these types are required to obtain both EPFO and ESIC registration through the MCA SPICe+ and AGILE-PRO forms at the time of company formation. You no longer need to go to the Shram Suvidha Portal for this.

Sole Proprietorship Firm, Partnership Firm, LLP, or any other establishment that does not go through the MCA incorporation route. Your EPF registration is done through the Shram Suvidha Portal. The process is fully online. It is a straightforward process when done correctly — but many business owners struggle with document requirements and get delayed unnecessarily.
As a trusted PF consultant in Delhi, Labour Law Wale handles the entire Shram Suvidha registration for you — documents, filing, follow-up, and certificate handover. You focus on your business; we handle the compliance.
Do You Know ?
Under the MCA portal process, new Private Limited Companies, Public Limited Companies and One Person Companies (OPCs) receive EPFO registration during incorporation. However, PF registration does not mean that PF contributions must start immediately. If a company has fewer than 20 employees, PF contributions are generally not required. Once the company employs 20 or more employees, it must comply with applicable EPF rules and deposit PF contributions as required by la

Important Facts For Employers
Inspection Relief For Start-ups
If your startup is DPIIT-recognised, you may get some relief from routine labour inspections through self-certification. The Startup India framework provides for a restricted inspection regime for eligible startups for a period of 3 to 5 years, subject to the applicable conditions. It is important to understand that self-certification does not mean exemption from PF or other applicable labour law requirements. Startups must continue to comply with the relevant statutory provisions, maintain proper records, make applicable contributions, and fulfil their reporting obligations.
PM Viksit Bharat Rozgar Yojana (PM-VBRY)
The PM Viksit Bharat Rozgar Yojana (PM-VBRY) started on 1 August 2025 to support job creation in India. Eligible first-time employees can receive up to ₹15,000, while eligible employers may get up to ₹3,000 per month for each additional employee, subject to scheme conditions. At Labour Law Wale, we help employers understand eligibility, follow PF compliance rules and claim applicable benefits. PF on Contract Workers — Who Is Actually Liable?
PF compliance for contract workers is an area that is often misunderstood by employers. Many organisations engage employees through contractors or manpower agencies and assume that the responsibility for PF compliance rests entirely with the contractor. However, the principal employer also has an important statutory responsibility to ensure that PF compliance is properly maintained for eligible contract workers.
The principal employer should therefore not rely solely on the contractor’s assurance that PF has been deposited. EPFO has advised principal employers to verify the contractor’s PF compliance, including checking the contractor’s PF registration and ensuring that statutory PF payments have actually been deposited.
What Is an Exempted Establishment?
Certain establishments may receive exemption under Section 17 of the EPF & MP Act, 1952 and manage employees’ PF through an approved PF Trust instead of the regular EPFO system. The Trust handles PF contributions, employee records, interest crediting, withdrawals and other day-to-day administration. However, exemption does not mean exemption from compliance. The establishment must follow all conditions of the exemption, maintain proper records and ensure that employees receive the prescribed PF benefits. EPFO continues to exercise regulatory and supervisory oversight over the exempted establishment. If the prescribed conditions are not followed, the exemption may be reviewed or withdrawn.

Why Should a Company Be Covered Under PF?
Stronger Employees. A More secure Businees
A lot of business owners see PF as just another compliance box to tick. The ones who have been running businesses for years see it very differently — it is one of the cheapest and most effective ways to build a company people actually want to work for and stay with.

You Attract Serious Candidates — Not Just Any Candidates
Experienced professionals check PF status before they even attend an interview. If your company does not offer PF, the best candidates quietly move on. They do not argue about it — they just choose someone else. PF compliance is your first filter for hiring quality people who plan to build a career, not just collect a salary.

Your Business Becomes Eligible for Government Tenders
Most government tenders, PSU contracts, and large corporate vendor empanelments require you to submit PF registration proof and compliance certificates as part of the application. Without it, you are disqualified before you even begin. Many businesses lose crore-worth contracts simply because their PF was not in order.

Your Employees Work Without Financial Anxiety
Your Employees Work Without Financial Anxiety An employee who knows their PF is being deposited on time every month has one less financial worry on their mind. That mental peace directly affects their focus, output, and commitment at work. Companies that understand this invest in compliance not just for legal reasons — but because it genuinely makes their team perform better.
