Labour Law Wale

Empowering Enterprises, Inspiring Excellence

If you have been looking for a PF consultant in Delhi who actually stays involved — not just someone who files your registration and disappears — you are in the right place. At Labour Law Wale, we have built our entire practice around one idea: businesses in Delhi deserve PF compliance that is handled properly, on time, every single month — without them having to chase anyone or worry about what EPFO might say next.
We work with businesses all across Delhi — from Rohini and Pitampura in the north, to Okhla and Saket in the south, Dwarka and Janakpuri in the west, Preet Vihar and Laxmi Nagar in the east, and the busy commercial hubs of Connaught Place, Karol Bagh, and Nehru Place in the centre. Wherever your office is in Delhi, Labour Law Wale is your PF consultant near you — not just in name, but in actual availability and response.
We have handled PF compliance for businesses of every type across Delhi — manufacturing units, IT companies, retail chains, staffing agencies, construction firms, hospitals, educational institutions, and startups that just crossed 20 employees. Every business had a different situation. Every solution we built was specific to them. That is the difference between a real EPF consultant and someone who treats every client the same way.
One thing that genuinely separates us from most other PF consultants in Delhi — we updated our complete process to align with the New Code on Social Security 2020 well before most firms even acknowledged it existed. While other consultants near you are still filing under the old EPF Act 1952 framework, our clients are already prepared for what is coming. That means no surprise penalties, no scrambling to restructure, and no back-dated liability showing up later.
We have defended businesses during EPFO inspections, responded to recovery notices, corrected years of incorrect filings, and set up clean monthly compliance systems from scratch. Since November 2025, we have done this for 60+ businesses across Delhi NCR. When you search PF consultant near me in Delhi — Labour Law Wale is the answer.

Most businesses in Delhi only realise they needed a proper PF consultant after something goes wrong — a missed filing, an EPFO notice, a contractor’s unfiled returns, or a salary structure that quietly increased their PF liability without anyone noticing. At Labour Law Wale, we make sure none of these situations ever reach your desk. We handle everything — proactively, accurately, and completely — so that your business stays protected and EPFO stays satisfied. That is what real PF consultancy in Delhi looks like.

Understanding EPFO

What Is EPF Registration

EPFO stands for Employees’ Provident Fund Organisation. It is a mandatory social security scheme managed by the Employees’ Provident Fund Organisation under the Ministry of Labour and Employment, Government of India — to provide financial security to employees after retirement, resignation, or in case of emergencies.
Under this scheme, both employer and employee contribute a fixed percentage of salary every month to the EPFO account. This money is saved in the employee’s PF account and can be used in the future. The Employees’ Provident Fund Organisation maintains all these accounts centrally.
As per the Act, once the employer meets the eligibility criteria they must register their establishment under the Act in EPF registration and deposit contributions for employees every month.
As a business owner in Delhi, staying compliant is not optional — it is a legal obligation from the very first day you cross the 20-employee threshold. The obligation to register begins on the exact day you cross the threshold, not when you apply for registration. Late registration means all contributions were due from that date, along with penalties and interest.
That is exactly where Labour Law Wale steps in. As the most trusted PF consultant in Delhi with 10+ years of hands-on EPFO experience, we handle your entire EPF lifecycle — from registration, monthly ECR filing to EPFO inspections and penalty resolution — so you can focus entirely on growing your business.

Did You Know?

Establishments having less than 20 employee can also get register for EFPO under Voluntary Coverage registration.

Who Must Register?

Any establishment crossing the threshold limit of 20 or more employees must mandatorily register under EPFO CoSS 2020. And once covered, an establishment remains permanently covered under EPF even if the employee count later drops below 20.

Contribution Rate

Under the EPFO Scheme the contribution rates remain 12% each for both employer and employee. The employee’s entire 12% goes into the EPF account, however the employer contribution splits into two parts: EPF 3.67%, EPS 8.33% = 12%. The employer also pays 0.50% EDLI and 0.50% EPF administrative charges separately.

Volunary Reggistration

If your company has fewer than 20 employees, EPF registration is not mandatory — but you can still choose to register voluntarily. This is called Voluntary Coverage under EPF. Once you register voluntarily, all the same EPF rules apply to your company — just like they do for companies with 20 or more employees.

PF Registration Depends On
the Type of Your Establishment

Most business owners assume PF registration works the same way for every company. It does not. The route you take depends entirely on the type of establishment you run — and getting this right from day one saves you a lot of unnecessary trouble later.

For Private Limited / OPC / Public Limited

Registration Through MCA Portal

Here is something most new business owners miss — if you are incorporating a Private Limited Company, Public Limited Company, or One Person Company (OPC), your PF registration does not happen separately. It happens automatically through the MCA Portal as part of the company incorporation process itself.
This rule has been in place since 08 October 2020. From that date, all newly incorporated companies of these types are required to obtain both EPFO and ESIC registration through the MCA SPICe+ and AGILE-PRO forms at the time of company formation. You no longer need to go to the Shram Suvidha Portal for this.

Think of it this way — your PF registration comes bundled with your company registration. You do not have to chase a separate process. By the time your company is incorporated, your PF registration is already done. Less running around, less paperwork, and one less deadline to worry about.

Having PF Number Does Not Mean Contributions Start Immediately
This is a very common confusion — and it costs people unnecessary stress. Getting a PF registration number does not mean you have to start making PF contributions right away.

PF contributions only become mandatory when your company reaches 20 or more employees. Until you hit that number, you can simply file Zero Returns every month or keep the registration inactive. There are no penalties for this. No pressure, no fines — just stay registered and stay ready.

For Proprietorship / Partnership / Other Firms

Registration Through Shram Suvidha Portal

If your business is a Sole Proprietorship Firm, Partnership Firm, LLP, or any other establishment that does not go through the MCA incorporation route — your PF registration is done through the Shram Suvidha Portal.
This is the traditional and most widely used route for PF registration. The process is fully online. You fill in the required details, upload your documents, and once EPFO verifies your application, your PF registration is granted. It is straightforward when done correctly — but many business owners struggle with document requirements and get delayed unnecessarily.

At Labour Law Wale, we handle the entire Shram Suvidha registration for you — documents, filing, follow-up, and certificate handover. You focus on your business, we handle the compliance.

Which Establishments Come Under PF Registration?
Here is a clear list of business types that need to register under EPF:

PF Rules & Facts Many Consultants Overlook

PF compliance rarely stops at registration and monthly payments. Employers who stop there end up missing schemes they could actually benefit from, or rules that quietly change their liability. This section brings together the parts most consultants skip past — startup inspection relief, employment-linked PF schemes like PM-VBRY, who is really responsible for a contract worker’s PF, and how exempted establishments work under their own approved trusts.

Startup PF Inspection Relief

If your startup holds a DPIIT recognition certificate, you get a significant compliance advantage that most startup founders do not know about. You are allowed to self-certify your PF and labour law compliance — which means regular EPFO inspections are generally restricted for 3 to 5 years from the date of recognition. This does not mean you are exempt from PF. Compliance is still fully required. What changes is the inspection process — instead of an EPFO officer visiting your premises, you declare your compliance yourself. However, complaint-based inspections can still happen. So stay compliant — self-certification is a privilege, not a free pass.

PF on Contract Workers — Who Is Actually Liable?

This is one of the most misunderstood areas of PF compliance — and one of the biggest reasons companies get EPFO notices they never saw coming. Many companies hire workers through a contractor or manpower agency and assume that PF is the contractor's responsibility. That assumption is legally wrong — and dangerously expensive. Under the EPF Act, the principal employer — meaning your company — is ultimately responsible for ensuring PF is deposited for all contract workers working on your premises. If the contractor fails to deposit PF, EPFO will come after you — not the contractor. This means if you have 8 direct employees and 15 contract workers — your total count is 23 for PF purposes. You have crossed the 20-employee threshold. PF registration becomes mandatory — and you are responsible for ensuring compliance for all of them. The safest way to handle this is to either verify monthly that your contractor is depositing PF — by checking ECR receipts — or engage a PF consultant who manages this on your behalf.

PM-VBRY — PF Employment Scheme (1Aug 2025)

The government launched PM-VBRY (Pradhan Mantri Viksit Bharat Rozgar Yojana) specifically to boost new employment through EPF. If you are hiring first-time employees — people who have never had a PF account before — both the employee and the employer can benefit. Eligible first-time employees can receive an incentive of up to ₹15,000, credited directly to their EPF account in instalments. Eligible employers who create new jobs and register those employees under EPF may also receive government incentives for a defined period. If your company is actively hiring freshers or first-time workers, this scheme is worth discussing with your PF consultant. Labour Law Wale can help you check eligibility and claim these benefits correctly.

What Is an Exempted Establishment?

What Is an Exempted Establishment? Not every company sends its employees' PF contributions to EPFO every month. Some establishments — usually larger ones — get permission to run their own approved PF Trust instead. This is called an exempted establishment, and the exemption is granted under Section 17 of the EPF & MP Act. Once exempted, the company's own Trust takes over the day-to-day work: opening and maintaining employee PF accounts, crediting contributions, keeping records, and processing withdrawals internally. But exemption is not a free pass. The establishment still has to meet every condition attached to it — including paying employees interest at a rate equal to or higher than what EPFO declares each year. EPFO does not step back either; it continues to audit the Trust and check whether contributions, interest payments, and record-keeping meet the required standard. If conditions are violated, the exemption itself can be withdrawn and the fund brought back under EPFO's direct control. Code on Social Security 2020 — PF Changes What Changed in PF Unde
